Welcome to ToyTech. By accessing our website or placing an order, you agree to be bound by the following Terms of Service. These terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

ToyTech is an Australian-owned and operated online retail business based in the Sydney Hills District, New South Wales. We sell toys, collectibles, and related products to customers throughout Australia.

2. Acceptance of Terms

By browsing our website, creating an account, or placing an order, you confirm that you are at least 18 years of age (or have parental/guardian consent) and accept these Terms of Service in full. If you do not agree to these terms, please do not use our website.

3. Products & Pricing

All prices on ToyTech are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable, in accordance with A New Tax System (Goods and Services Tax) Act 1999.

Prices are subject to change without notice
We reserve the right to cancel or refuse any order where a pricing error has occurred
Product images are for illustration purposes — minor packaging variations may occur
All products sold are genuine, official stock sourced from authorised Australian distributors
Stock availability is not guaranteed — we will notify you promptly if an ordered item is unavailable

4. Orders & Payment

When you place an order on ToyTech, you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is confirmed once you receive an order confirmation email from us.

Accepted payments: Visa, Mastercard, AMEX, PayPal, Apple Pay, Google Pay, Afterpay
Afterpay is provided by Afterpay Pty Ltd — subject to Afterpay's own terms and conditions
Payment is processed securely via Shopify Payments using 256-bit SSL encryption
ToyTech does not store your full card details
Orders cannot be modified after payment is confirmed — contact us immediately if changes are needed

5. Delivery & Shipping

We dispatch orders within 1–2 business days from our Sydney Hills District warehouse. Delivery is via Australia Post, Courier Please or Aramex. All orders include tracking. Estimated delivery timeframes are guides only and not guaranteed. Full details are available on our Delivery Info page.

Risk of loss and title for products passes to you upon delivery to the shipping address provided at checkout. ToyTech is not liable for delays caused by the carrier, incorrect addresses, or circumstances outside our control.

6. Returns, Refunds & Consumer Guarantees

Australian Consumer Law: Our products come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

In addition to your statutory rights, ToyTech accepts returns within 14 days of delivery for items that are damaged, faulty, or in original unopened condition (change of mind). For change-of-mind returns, the buyer is responsible for return postage costs. Opened items cannot be returned. Full details are on our Returns & Refunds page.

7. Privacy & Data

ToyTech collects and handles your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We collect your name, email, address and payment details solely for the purpose of processing and fulfilling your order.

We do not sell, rent or share your personal information with third parties for marketing purposes
Your data is stored securely on Shopify's platform, which is PCI DSS compliant
You may request access to, correction of, or deletion of your personal data at any time by contacting us

8. Intellectual Property

All content on the ToyTech website — including text, images, logos, graphics and design — is the property of ToyTech or its licensors and is protected under Australian copyright law. You may not reproduce, distribute or use any content from this site without our express written permission.

Product names, trademarks and brand names (including Pokémon, LEGO, Hot Wheels, Oral-B) remain the property of their respective owners. ToyTech is an authorised reseller and is not affiliated with or endorsed by those brands.

9. Limitation of Liability

To the fullest extent permitted by Australian law, ToyTech's liability for any claim arising from the use of our website or products is limited to the purchase price of the product in question. We are not liable for indirect, incidental or consequential damages. Nothing in these terms excludes your rights under Australian Consumer Law.

10. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of ToyTech shall be subject to the exclusive jurisdiction of the courts of New South Wales.
